Terms of Service
External property check-ins and photographic reporting.
The enquiry acknowledgement does not create a booking or waive your consumer rights.
1. Who provides the service
Skye Property Watch is operated by Kyle Hewitson, a sole trader based in Dunvegan, Isle of Skye. Contact: skyepropertywatch@outlook.com. Full trader and contact details will accompany the written quotation before any contract or payment.
2. Your enquiry and booking
Submitting an enquiry, including acknowledging these terms, does not reserve an appointment, create a paid booking or authorise work. We review the property, access, requested package and availability first. You receive a written quotation specifying the scope, total price including any applicable taxes and travel supplement, visit window, report deadline and applicable terms. After you accept the quotation, we send an invoice. The booking is formed when we send written confirmation following payment. If we cannot confirm it, we refund you in full. We supply the agreed terms by email for your records before work starts. Material changes require agreement; website updates do not retrospectively change your booking.
3. Standard and Enhanced Check-Ins
Standard Check-In is £60 within the confirmed local service area. It includes an external walk-around from safely accessible positions, ground-level photographs, a structured observation checklist, a dated digital report and communication of significant visible concerns identified during the visit. Enhanced Check-In is £70 and adds meaningful elevated photographic viewpoints using a telescopic camera where safely and practically achievable. Both packages cover one main property and its agreed immediate grounds. Larger properties and travel outside the core area are quoted individually before payment. There is no subscription or automatic renewal.
4. If elevated photographs cannot be obtained
The Enhanced price pays for additional photographic documentation, not a roof survey or greater diagnostic assurance. Height, sightlines and access may prevent useful additional views. If meaningful additional elevated photographs cannot be supplied, the service is charged at £60 instead of £70. If already paid, the £10 difference is refunded, normally to the original payment method, without undue delay and within 14 days of the adjustment being agreed. Any separately agreed travel supplement is unchanged. We do not promise a separate return visit for the upgrade. This does not restrict remedies if we fail to provide the service with reasonable care and skill.
5. What the check records
We record reasonably observable external conditions during the agreed visit, using reasonable care and skill. Visible doors, windows, walls, rooflines, gutters, gates, fences, access routes and immediate grounds may be documented where safely visible and within the agreed scope. The report identifies viewing positions, material restrictions and areas not assessed. Photographs are a record of available views, not proof that every part of the property was examined.
6. What is not provided
This is not a building, structural, condition or roof survey; a professional construction assessment; safety certification; or an insurance-compliance inspection. We do not enter buildings, examine or test individual tiles or slates, test plumbing, heating or electrics, undertake intrusive investigation, climb ladders or roofs, perform work at height, repair or maintain property, move debris, inspect outbuildings or search wider croft or farm grounds. We do not provide security guarding, continuous monitoring, emergency attendance or guaranteed same-day response. Elevated photography is undertaken from safe ground positions and is not physical roof access.
7. Visibility and the meaning of a report
Building height and design, distance, vegetation, weather, lighting, restricted access and concealed areas can limit what is visible. Some defects may not be apparent. No reported concern is not proof that the property is defect-free, secure, watertight or safe. Observations relate to the stated visit time; conditions can change afterwards. We do not diagnose causes or certify technical condition. These scope limits do not excuse a failure to carry out the agreed service with reasonable care and skill.
8. Your insurer and other formal requirements
Do not rely on this service as automatically satisfying vacant-property, second-home or other insurance conditions. Your insurer may require internal inspections, specific visit intervals, precautions, qualifications or records which we do not provide. You are responsible for checking your policy directly with your insurer and arranging any required service. We do not certify compliance or produce a professional survey or certificate for insurance, mortgage, sale, building-control or other formal purposes. A customer may share the factual report, but that does not change the service into certification or establish that a third party will accept it.
9. Access and customer information
You must have authority to arrange the visit and provide accurate location details, permission to enter the agreed grounds, known hazards and workable access arrangements. Send sensitive codes separately through an agreed channel, not the enquiry form. We will not force entry or bypass restrictions. If we travel but cannot perform the agreed check because agreed access details were missing or incorrect, we will attempt to contact you and explain the outcome. Any retained charge is limited to reasonable travel costs actually incurred, capped at £10 for North or Central Skye and £20 for South Skye, as confirmed in your quotation. The remaining payment is refunded. These are failed-access caps, not newly introduced travel supplements, and do not override cancellation or other statutory rights.
10. Appointments, conditions and incomplete visits
Visits are scheduled mainly on Saturdays and Sundays; weekdays are by arrangement. North-west Skye is our core area. Wider journeys require individual agreement. Winter appointments account for shorter daylight hours to allow useful photographs. Unsafe weather, roads or access may require postponement. If we cannot attend safely, we offer an alternative; if none is agreed, you receive a full refund without a travel deduction. If the agreed check cannot be materially completed, we explain what was and was not achieved and agree an appropriate rescheduling or refund outcome. A restricted view is recorded explicitly and is never silently marked satisfactory. Your statutory remedies remain available.
11. Reports, concerns and contractors
Your quotation confirms the report deadline, normally within two days of the visit. Reports contain observations and labelled photographs, with restrictions and suggested follow-up where appropriate. Significant apparent concerns are flagged promptly through the agreed contact method; we cannot guarantee immediate receipt or response. You arrange any specialist investigation, repairs or protective action needed. We may provide possible contractor contacts for you to assess and appoint independently, but do not manage repairs or guarantee third-party availability or work.
12. Cancellation and early commencement
For consumer bookings made remotely, you normally have 14 days from the day after the contract is formed to cancel without giving a reason. Email us with your booking reference or use the cancellation form below. Before starting within that period, we obtain a separate express request and explain the consequences. If you cancel after requesting an early start, a lawful proportionate amount for service actually supplied may be payable. You lose the cancellation right after full performance only if you expressly requested the early start and acknowledged that consequence; full performance includes the agreed report. The enquiry checkbox is not that request or acknowledgement. Where work has not started, we offer a full refund. Refunds due on cancellation are made without undue delay and within 14 days of notification, normally to the original payment method. No additional card-processing deduction is imposed.
13. Reasonable care, remedies and liability
We must provide the agreed service with reasonable care and skill. Nothing in these terms excludes or restricts rights under the Consumer Rights Act 2015 or other applicable mandatory consumer law, or liability that cannot lawfully be excluded, including death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Where the service fails to meet the contract, statutory remedies may include repeat performance or a price reduction where applicable. We do not use the customer acknowledgement as a waiver of negligence or statutory rights. Defining the agreed scope does not make us immune from claims.
14. Questions, complaints and applicable law
Please email skyepropertywatch@outlook.com with the booking reference and details of any concern. We will investigate and discuss appropriate next steps or remedies. Scottish law governs the agreement, without removing mandatory protections or court rights available to consumers in their place of residence. No complaint deadline in these terms shortens statutory rights.
15. Future aerial photography
Drone photography may be introduced in future on request or where useful. It is not currently available to book or included in any promised deliverable. It will only be offered after appropriate insurance and lawful operating arrangements are confirmed, and will remain subject to site suitability, permissions and weather. No flight, complete roof view or separate return visit is guaranteed.
